1. Acceptance of Terms

By accessing or using Nibemo ("Service"), you agree to be bound by these Terms of Use. If you do not agree, please do not use the Service.

2. Description of Service

Nibemo provides AI-powered website creation, hosting, and sharing services. We reserve the right to modify or discontinue the Service at any time.

3. User Accounts

• You are responsible for maintaining the confidentiality of your account credentials
• You must provide accurate and complete information
• You are responsible for all activities under your account
• You must be at least 18 years old to use the Service

4. Service Delivery

• Digital Service: Nibemo is a fully digital service delivered instantly upon account creation
• Access: Immediate access to all features according to your subscription plan
• Availability: The Service is available 24/7 via internet connection
• No Physical Delivery: No physical products or shipments are involved

5. Age Restriction

This Service is for users aged 18 and above only. By using the Service, you confirm that you are at least 18 years old.

6. Subscription and Cancellation

• Cancel anytime:You may cancel your subscription at any time from Settings → Billing & Subscription → Cancel Subscription.
• Access retention: After cancellation, your subscription remains active and you retain full access until the end of your current billing period.
• Refunds:Credits that have already been consumed cannot be refunded. For unused credits, or if something went wrong, contact us and we'll make it right.

7. Subscription Credits and Usage Limits

• Monthly credits: Subscription plans include monthly credits for AI-powered features (page generation, images, edits, text generation).
• Non-accumulating: Credits are valid only for the current billing period and do not roll over to subsequent months.
• Consumed credits: Credits already used cannot be returned. For unused credits or issues with a generation, contact support@nibemo.comand we'll review case by case.
• Service access model: Subscription fees grant access to the platform and services during the subscription period, not prepayment for individual service units.
• Credit reset: Credits reset at the start of each billing cycle based on your subscription renewal date.

8. Privacy and Data Protection

• Privacy Policy: Your use of Nibemo is also governed by our Privacy Policy.
• Data collection: We collect only the information necessary to provide the Service.
• Data security: We apply industry-standard security measures to protect your data.
• Your rights: You have the right to access, correct, or delete your personal data (see Privacy Policy for details).

9. Communications

By creating an account, you agree to receive the following communications from us:

• Service notifications: Updates about your account, pages, and subscription status
• Product updates: New features, tips, and improvements to the platform
• Promotional offers: Special offers, discounts, and recommendations relevant to your use of the Service

You may opt out of promotional communications at any time via the unsubscribe link in every email, or by contacting support@nibemo.com. Service-related notifications (billing, security) cannot be opted out of while your account is active.

10. Use of Artificial Intelligence (AI)

The Service uses third-party AI services to generate websites, text, and images.

• Data transmission: Content you enter (including text, business descriptions, prompts, and other data) is transmitted to third-party AI providers (Google, Anthropic, OpenAI) for processing. These providers handle the data under their own privacy policies and terms of service.
• Sensitive information: Do not submit sensitive, confidential, or personal information that is not intended for publication when using AI features.
• AI-generated content: AI-generated pages, text, and images may contain errors, inaccuracies, or inappropriate content. You are responsible for reviewing and verifying all generated content before publishing or sharing.
• No guarantees: Nibemo does not guarantee the accuracy, completeness, or suitability of AI-generated outputs.

11. Beta Status and Service Continuity

The platform is currently in Beta. This means the service is still under active development and may change at any time.

• Service availability: Features, functionality, and availability may change, be modified, or be removed without prior notice during the beta period.
• No uptime guarantee: The platform may experience downtime, errors, or interruptions during the beta period.
• Data persistence: We make reasonable efforts to preserve user data, but content created during beta may be affected by system changes. Export or back up important content.
• Feedback: Beta users are encouraged to report issues and provide feedback.
• Discontinuation of the Service: If we decide to discontinue Nibemo or any material part of it, we will give reasonable advance notice by email and, where technically practical, provide a way to export the pages you created so you can host them elsewhere.

12. Demo / Trial Usage

The platform may offer a Demo or Trial version that allows users to evaluate the service for a limited period and create digital assets within certain limits.

• Variable limits: The number of assets that may be created during the demo period, and the demo duration, may change from time to time according to platform configuration.
• Evaluation purpose: The demo is intended for evaluation only. Nibemo reserves the right to limit, remove, or disable demo assets, and to prevent repeated or abusive use of demo access at its discretion.
• Post-demo access: After the demo period ends, certain features or content may no longer be available unless the account is upgraded to a paid plan.

13. Acceptable Use

You agree NOT to:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Upload malicious code or viruses
• Harass, abuse, or harm others
• Use the Service for spam or unauthorized advertising
• Create pages with offensive, illegal, or inappropriate content
• Attempt to gain unauthorized access to our systems

13.1 Strictly Prohibited

The following uses are prohibited. Accounts used for them may be suspended or terminated immediately, without notice and without refund:

• Fraud and deception. Phishing, credential harvesting, impersonating any person or organization, and any content designed to deceive people into parting with money, credentials, or personal data.
• Gambling. Gambling, betting, wagering, lotteries, prize draws, and games of chance or skill played for money or anything of value.
• Unauthorized collection or transfer of personal data belonging to visitors of pages you create.
• Malware, and the sale or promotion of illegal goods or services.
• Content that sexually exploits minors, and content inciting violence.

We may review account activity and content to enforce these Terms, and we determine in our sole discretion whether a use falls within this section.

14. Content Ownership

• You retain ownership of content you upload to your pages.
• AI-generated output: Pages, text, and images generated for you by Nibemo using AI are yours to use, subject to the terms of the AI providers we rely on (see Section 10). Nibemo does not claim ownership of generated output produced for your account.
• You grant Nibemo a license to host, display, and distribute your content as necessary to provide the Service.
• Nibemo does not claim ownership of your content.
• Your responsibility for content and outputs: You are responsible for the content you upload, submit, generate, export, download, or otherwise use through the Service. You represent and warrant that you have all rights, licenses, permissions, and authority necessary to use such content and any outputs created from it.
• No rights to third-party IP: Nibemo does not grant you rights to any third-party trademarks, logos, characters, copyrighted works, or other intellectual property. You may not use the Service to infringe, misappropriate, or violate the rights of others.
• Removal: We may remove, restrict, or disable access to content or outputs if we believe they violate these Terms, applicable law, or the rights of any third party. To report content you believe infringes your rights, contact support@nibemo.com.

15. Intellectual Property

The Nibemo platform, including design, code, logos, and trademarks, is owned by Nibemo and protected by intellectual property laws.

16. Termination

We reserve the right to suspend or terminate your account for:

• Violation of these Terms
• Any use listed in Section 13.1 (Strictly Prohibited) - immediately, without notice and without refund
• Illegal activity
• Non-payment (for paid plans)
• Inactivity (with notice)

17. Limitation of Liability and Indemnification

Nibemo is provided "as is" without warranties. We are not liable for:

• Service interruptions or data loss
• Indirect, incidental, or consequential damages
• Third-party content or actions

Indemnification: You agree to defend, indemnify, and hold harmless Nibemo from and against any claims, damages, liabilities, losses, costs, and expenses arising from your content, your outputs, your use of the Service, or your violation of these Terms or any third-party rights.

18. Changes to Terms

We may update these Terms at any time. Continued use of the Service constitutes acceptance of updated Terms.

19. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of Israel, without regard to its conflict-of-law provisions. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of Tel Aviv-Yafo, Israel. Nothing in this section limits any mandatory consumer-protection rights you may have under the laws of your country of residence.
